Vous vous engagez à :

14. RELATIONS WITH THE PARTNERS AND ADVERTISERS

Cette garantie couvre toute somme que Les Etablissements Olhaïtz seraient tenus de verser à quelque titre que ce soit, y compris les honoraires d'avocat et frais de justice reconnus ou prononcés, dans une limite raisonnable. L'utilisation des Services n'est assortie d'aucune garantie quelle qu'elle soit. Les Etablissements Olhaïtz n'accordent aucune garantie expresse ou implicite, quant à l'utilisation des Services par l'Utilisateur et notamment sur la disponibilité, le caractère opportun, actuel, fiable et utile des Services et de leurs contenus.

De même Les Etablissements Olhaïtz ne garantissent pas que les contenus et services obtenus par l'Utilisateur sur les Services seront conformes à ses attentes, et que les contenus et services fournis sont conformes à toute réglementation ou droit de tiers.

17. GARANTIE

Les Etablissements Olhaïtz ne peuvent en aucun cas être tenus pour responsables de la fiabilité de la transmission des données, des temps d'accès, des éventuelles restrictions d'accès sur le réseau Internet ou les réseaux qui lui sont connectés. La responsabilité des Etablissements Olhaïtz ne peut être engagée en cas d'interruption des réseaux d'accès aux Services, d'indisponibilité totale ou partielle des Services résultant notamment de l'opérateur de télécommunications, en cas d'erreur de transmission ou de problèmes liés à la sécurité des transmissions, en cas de défaillance du matériel de réception ou de votre ligne téléphonique.

Les Etablissements Olhaïtz peuvent être amenés à interrompre leurs Services pour des raisons de maintenance. Cette interruption sera notifiée au moyen d'un avertissement figurant sur la page d'accueil ou par tout autre procédé. Cette interruption ne peut en aucun cas engager la responsabilité des Etablissements Olhaïtz et n'ouvre droit à aucune indemnité.

En aucun cas la responsabilité des Etablissements Olhaïtz ne pourra être engagée pour les dommages indirects et notamment tout préjudice commercial, moral et financier en ce compris toute perte de bénéfices ayant pour cause, origine, ou fondement, l'utilisation des Services ou leurs contenus.

Les Etablissements Olhaïtz n'assument aucune responsabilité relative à l'utilisation des Services ou leurs contenus. Les contenus et services fournis par les partenaires des Etablissements Olhaïtz par l'intermédiaire des Services, le sont sous la responsabilité exclusive des partenaires des Etablissements Olhaïtz. Ainsi Les Etablissements Olhaïtz ne sont aucunement responsables des dommages directs ou indirects, survenant notamment à l'occasion de l'accès de l'Utilisateur aux Services ou de l'utilisation des Services, du non respect des Services ou de leurs contenus à toute réglementation ou toute atteinte aux droits de tiers.

The Olhaïtz Establishments do not assume any comparative
responsability to the use of the Services or their contents. The
contents and services provided by the partners of the Olhaïtz
Establishments by the intermediary of the Services, are it under the exclusive responsibility of the partners of the Olhaïtz
Establishments. Thus the Olhaïtz Establishments are not at all
responsible for the direct or indirect damage, occurring in particular at the time of the access of the User to the Services or the use of the Services, nonthe respect of the Services or their contents with any regulation or very reached with the rights of third.

A défaut de règlement amiable, le litige sera soumis au droit français, et porté devant le tribunal compétent dans le ressort de la cour d'appel de Paris statuant en droit français.

20. APPLICABLE LAW - ATTRIBUTION OF COMPETENCE
